These terms are the agreement between you and Timothy Hahn ("we", "us") for using the GathrRound app and website. By creating an account or using GathrRound, you agree to them. If you don't agree, please don't use GathrRound.

Our Privacy Policy explains what information we collect and how we use it. It is part of these terms.

1. Who can use GathrRound

You must be at least 13 years old to use GathrRound. If you are under 18, you need permission from a parent or guardian, who agrees to these terms for you.

You may not use GathrRound if we have previously removed your account for breaking these terms.

2. Your account

• Give accurate information when you sign up, and keep it up to date. Use your own name, email address, and phone number.
• We confirm your email address and phone number to help keep accounts real and secure.
• Keep your password private. You are responsible for what happens in your account.
• One person, one account. Don't create an account for someone else or pretend to be someone you're not.
• Tell us right away at info@gathrround.com if you think someone else has used your account.

3. How to behave

GathrRound is for planning real get-togethers with people you know. When you use it, you agree not to:

• harass, threaten, bully, or intimidate anyone;
• post anything illegal, hateful, sexually explicit, or violent, or anything that exploits or endangers children;
• share someone else's private information without their permission;
• send spam, advertising, or invitations to people who wouldn't want them;
• post content you don't have the right to share, such as photos or text that belong to someone else;
• impersonate another person or misrepresent who you are;
• use GathrRound to plan or promote anything illegal or dangerous;
• try to break, overload, copy, or get around the security of GathrRound, or collect other people's information from it;
• use GathrRound to look up phone numbers for anything other than finding your own friends.

If you see something that breaks these rules, report it in the app (on the person's profile, the event, or the message) or email info@gathrround.com. We review reports within 24 hours and may remove content or accounts that break these terms.

You can block anyone. A blocked person can't send you friend requests or invite you to events or groups, and you won't see their chat messages.

4. Your content

You own what you post on GathrRound: your profile, photos, events, messages, polls, and notes ("your content").

So that the app can work, you give us permission to store, copy, display, and deliver your content to the people you choose to share it with (for example, the people invited to your event or in your group). This permission is worldwide, free of charge, and lasts only as long as your content is on GathrRound. We don't sell your content or use it for advertising.

You are responsible for your content. Only post things you have the right to share.

GIFs in chats are provided by GIPHY and are subject to GIPHY's own terms.

5. Events and meeting people

GathrRound is a tool for organizing. We don't organize, host, supervise, or check any event, and we don't check the identity or background of anyone who uses GathrRound.

• Hosts are responsible for their events, including the location, safety, and anything required by law.
• You decide which events to go to and who to meet. Use the same good judgment you would anywhere else.
• Event details, guest lists, and reminders come from the people using the app. We can't promise they are accurate or that an event will happen.

6. Invitations, texts, and notifications

• When you invite someone who isn't on GathrRound, the app opens your phone's own messaging app and you send the text yourself. Your mobile plan's normal message charges apply. Only invite people who would be happy to hear from you.
• We send a text message with a code to confirm your phone number. Message and data rates may apply.
• We send push notifications and emails about your account and your events. You can choose which ones you get in Settings. Some messages about your account or security can't be turned off.

7. Things we remove automatically

To keep GathrRound tidy and private, events are deleted 14 days after they end, along with their guest lists, chats, and photos. Save anything you want to keep before then.

You can delete your account at any time in Settings. This permanently removes your profile, events, messages, and other content, and can't be undone.

8. Paid features

GathrRound is free to use today. If we add paid features or subscriptions, we will show you the price and terms before you buy anything. Purchases made through the App Store or Google Play are also subject to their terms.

9. Our rights in GathrRound

The GathrRound app, name, logo, and design belong to us. We give you a personal, non-transferable permission to use the app for its intended purpose. Please don't copy, modify, or resell it.

10. Changes and availability

We are always working on GathrRound, so features may change, be added, or be removed. We try to keep the app running smoothly, but we can't promise it will always be available or free of errors.

11. Suspending or closing accounts

You can stop using GathrRound and delete your account at any time.

We may suspend or close your account, or remove your content, if you break these terms, if we need to in order to protect other people or GathrRound, or if the law requires it. Where we reasonably can, we will tell you why.

12. No warranties

GathrRound is provided "as is" and "as available". To the fullest extent the law allows, we make no promises or warranties about it, including that it will be uninterrupted, secure, or error-free, or about the behavior of other people who use it.

13. Limits on our responsibility

To the fullest extent the law allows, we are not responsible for indirect, incidental, special, or consequential losses, for lost data, or for anything that happens at or because of an event or a meeting between people who use GathrRound.

Our total responsibility to you for any claim about GathrRound is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.

Some places don't allow these limits, so some of them may not apply to you. Nothing in these terms takes away rights you have under the law that can't be waived.

14. If your use causes a claim

If someone brings a claim against us because of your content, your event, or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim, as far as the law allows.

15. Changes to these terms

We may update these terms from time to time. If the changes are significant, we will let you know in the app or by email before they take effect. If you keep using GathrRound after that, you accept the new terms.

16. Governing law

These terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-law rules. Any dispute will be handled by the courts located there, unless the law where you live gives you the right to use your local courts.

If any part of these terms is found not to be enforceable, the rest still applies.
